UPDATE ARREST MADE IN ADAMS COUNTY PURSUIT
On March 16, 2010, at approximately 10:30 p.m., a deputy from the Adams County Sheriff's Office attempted to stop a vehicle in the area of Pecos Street and Orchard Drive, for a traffic violation. The driver of the vehicle, an older model, blue, four-door, Buick passenger vehicle, began to elude the deputy.
When the pursuit reached Highway 224 and Washington Street, the pursuit was terminated at the direction of the duty sergeant. Another deputy then saw the same vehicle turn west onto 64th Avenue from Washington Street, which dead-ends. Deputies then responded to the area to attempt to contact the driver of the vehicle. When deputies arrived in the area, the driver was stopped and a female was exiting the passenger’s side of the vehicle with a six-month-old baby, who was in a car seat. As deputies began giving verbal commands to the driver and to the female the driver put the vehicle in reverse and drove through a fence at a high rate of speed. The driver then put the vehicle in drive and drove towards a deputy who had exited his vehicle. The deputy fired at the vehicle. The driver continued to drive eastbound on 64th Avenue until going southbound on Washington Street. The pursuit continued into Denver until being terminated in the area of 14th and Court Place.
The female passenger of the vehicle, Kristin Akin, 24, of unincorporated Adams County, was treated at the scene for minor injuries and was later taken to the Adams County Detention Facility for an outstanding warrant for theft. Akin is being held on a seven-hundred and fifty dollar bond. The baby was released to Adams County Social Services.
The driver of the vehicle was identified as David Andrew Herr, 25, of unincorporated Adams County. Herr remained at large until March 18, 2010, at approximately 5:00 p.m. Deputies from the Adams County Sheriff’s Office and officers from the Federal Heights Police Department located Herr in the 8800 block of North Federal Blvd in Federal Heights. Herr was taken into custody after a short foot pursuit. He was booked into the Adams County Detention Facility where he is being held on a $20,000 bond for charges of Criminal Attempt 2st Degree Murder, 1st Degree Assault, Child Abuse, and Vehicular Eluding, stemming from the incident on March 16. Herr is also being held, without bond, for a warrant out of the Department of Corrections for Parole Violation for Assault. The vehicle has also been located.
