On October 1, 2010 at approximately 12:19 AM, Thornton Police responded to the 3200 block of E. Thornton Parkway on reports of a head-on traffic collision involving a motorcycle and SUV. On scene officers discovered a deceased male lying on the roadway.
Witnesses testified at trial that the SUV, driven by Wittig, was headed westbound in the eastbound lanes of the 3200 block of Thornton Parkway. Evidence was presented that Wittig turned into the lane of oncoming traffic hitting the victim, John Hines (DOB: 03/07/1977), head-on. In addition, the Colorado Department of Health toxicology report stated Wittig was under the influence of Xanax, Valium, Percocet and marijuana. Wittig admitted to self medicating and being under the influence. Deputy District Attorney Ben Hartford stated in his closing argument, “The defendant made a decision to get behind the wheel of a car knowing he was under the influence of drugs. [A decision which] resulted in taking the life of John Hines.”
After four and a half hours of deliberation an Adams Count Jury found Wittig guilty of Vehicular Homicide DUI (F3) and Vehicular Homicide Reckless (F4). The sentencing range is four to 12 years in the Department of Corrections. Witting will be sentenced on July 27, 8:30 AM in Adams County District Court, Division E.
